Excellencies,
I would like to once again thank Your Excellencies for making possible the positive results of the informal ASEAN Foreign Ministers’ Meeting in Jakarta, 22 February 2011.
As a follow up to the said meeting, and in accordance with the “Statement by Chairman of the Association of Southeast Asian Nations (ASEAN) following the Informal Meeting of the Foreign Ministers of ASEAN, Jakarta, 22 February 2011”, I have the honour to submit herewith:
It is my sincere hope, in view of the importance of the subject matter, that I can receive the views of Cambodia and Thailand on the said drafts at the earliest opportunity to be reflected in a subsequent draft. I shall only initiate the process of exchange of letters once agreement has been reached between all three countries, namely: Cambodia, Indonesia and Thailand.
Meanwhile, I should like to inform Your Excellencies that Indonesia has initiated the national preparation for the assignment of the aforementioned observers.

I have the honor to refer to the Statement by the Chairman of the Association o Southeast Asian Nations (ASEAN) following the Informal Meeting of the Foreign Minister of ASEAN, Jakarta, 22 February 2011, which inter alia,
Welcome in this regard, the invitation by both Cambodia and Thailand for observers from Indonesia. Current Chair of ASEAN, to respective side of the affected areas of the Cambodia-Thailand border. To observe the commitment by both sides to avoid further armed clashes between them, with the following basic mandate:
“to assist and support the parties in respecting their commitment to avoid further armed clashes between them, by observing and reporting accurately, as well as impartially on complaints of violations and submitting its findings to each party through Indonesia, current Chair of ASEAN”
In this connection, I have the further honor to propose Terms of Reference on the Deployment of the Indonesia Observer Team (IOT) in the affected areas of the Cambodia-Thailand Border as annexed.
I wish also to inform you that I am simultaneously submitting an identical letter attaching the afore-mentioned Terms of Reference to the Deputy Prime Minister and Foreign Minister of the Kingdom of Cambodia, H.E. Mr.Hor Namhong.
I would be grateful should you confirm, on behalf of the Government of the Kingdom of Thailand, your acceptance of the provisions of The Terms of Reference and also confirm your understanding hat this letter and its annex, together with your reply, shall constitute a legally binding instrument among the Government of the Kingdom of Cambodia.
The Terms of Reference shall come into effect on the date upon which Indonesia receives communication from the latest party confirming its agreement to the Term of Reference. which I shall subsequently notify both parties on the entry into force of the Term of Reference.

ANNEX
TERMS OF REFERENCE
OBJECTIVE
In accordance with the Statement by the Chairman of the Association of Southeast Asian Nations (ASEAN) following the Informal Meeting of the Foreign Ministers of ASEAN, Jakarta, 22 February 2011 :
“To assist and support the parties in respecting their commitment to avoid further armed clashes between them, by observing and reporting accurately, as well as impartially on complaints of violations and submitting its finding to each party through Indonesia, current Chair of ASEAN”;
COMPOSITION
The Indonesian Observers Team (IOT) shall consist of thirty military personnel and civilian officers of the Government of The Republic of Indonesia.
The thirty-member IOT shall be composed and deployed in the following manner;
STATUS
The IOT personnel shall have privileges duly accorded to Resident Diplomatic Representatives.

AREA OF COVERGE
The area of coverage of the IOT-C shall be the Cambodian side of the affected areas of the Cambodia-Thai border, namely :[TO BE INSERTED]
The area of coverage of the IOT-T shall be the Thai side of the affected areas of the Thai-Cambodia border, namely :[TO BE INSERTED]
ROLE AND RESPONSIBILITY
The IOT personnel shall:

The parties shall provide:

TERMINATION AND/OR SUPENSION
The Indonesian Government may cease or suspend the performance of the functions with due notice to the parties in the event of;

ANNEX

“To assist and support the parties in respecting their commitment to avoid further armed clashes between them, by observing and reporting accurately, as well as impartially on complaints of violations and submitting its finding to each party through Indonesia, current Chair of ASEAN”;
COMPOSITION
The Indonesian Observers Team (IOT) shall consist of thirty military personnel and civilian officers of the Government of The Republic of Indonesia.

STATUS

ROLE AND RESPONSIBILITY
The IOT personnel shall:
- Observe and monitor the ceasefire as agreed by the parties;
- Conduct field verification to validate any report of violations of ceasefire as agreed by the parties;
- Coordinate closely with the parties in the conduct of field verification and validation of reported any violations to the ceasefire as agreed by the parties;
- Maintain strict impartiality, objectivity, and independence in the conduct of their mandate and tasks, and shall respect the national laws and regulations of the Kingdom of Cambodia(for IOT-C personnel) and the Kingdom of Thailand (for IOT-T personnel);
- In carrying out their mission, refrain from any activities not compatible with its nature and purpose;
- Hold regular consultations and meeting with the parties in order to resolve any problems in the performance of its function;
- Not to carry arms and be in uniform with identifying insignia.
- Assume full responsibility for the security of the IOT personnel deployed in the mission;
- Take all necessary measures for the protection, safety and security of the IOT personnel;
- Ensure free movement throughout the area of coverage in the performance of the IOT’s function;
- Promptly provide safe passage in the event of evacuation of mission from the area of coverage.
REPORTING
- The IOT shall render daily report to Indonesia, current Chair of ASEAN;

- The IOT shall verify and render immediate report of violations of the ceasefire, as agreed by the parties and other matters requiring urgent attention by Indonesia, current Chair of ASEAN.
ADMINISTRATIVE AND SUPPORT ARRANGMENTS
The parties shall provide:
- Adequate quarters, communication support and facilities;
- Appropriate air and land transportation with pilot/driver;
- Liaison officers and mobile teams to facilitate coordination.
- Salaries and allowances;
- Transportation cost to the capital of the parties while transportation to the border areas shall be shouldered by the respective parties.
The Terms of mandate shall be [TO BE INSERTED] months from the date of the coming into effect of the present Terms of Reference and may be amended with the agreement of all three parties concerned.
The implementation of the IOT Terms of Reference shall be reviewed on a [TO BE INSERTED] monthly basis.
TERMINATION AND/OR SUPENSION
The Indonesian Government may cease or suspend the performance of the functions with due notice to the parties in the event of;
- The field situation mounts to endangering and threatening the life to the Indonesia observers;
- The parties fail to fulfill their commitments and responsibilities to the ceasefire process as stipulated in the Terms of Reference ; or
- The parties deliberately ignore to take action on any of its recommendation on violations of ceasefire
